The Allen County Regional Water & Sewer District (“District”) issued a 90-day final connection notice on July 14th, 2020, to bring properties in compliance with Indiana law and the District’s Ordinance No. 2020-07-22a. This will be the District’s final attempt before pursuing other avenues to insure compliance with Indiana law.
Those efforts may include:
- A FINE OF $100 PER DAY FOR EVERY DAY THE PROPERTY IS NOT CONNECTED TO THE COLLECTION SYSTEM; AND/OR
- LEGAL ACTION FILED WITH A COURT (OF COMPETENT JURISDICTION) TO FORCE CONNECTION OF THE PROPERTY, INCLUDING THE COST OF THE ACTION, ALL PENALTIES, INCLUDING THE ABOVE PENALTIES, ANY UNPAID RATES AND CHARGES AND ATTORNEY’S FEES.
In addition, if you are not connected, and it is determined that you have a failing septic system, the Property could eventually be condemned by the Allen County Health Department preventing the use and occupancy of the Property.
